The article investigates the cross-section between the digital public administration and public procurement procedures. The Hypothesis from which the investigation starts is that the characteristics and institutes of the national public procurement legislation limit the use of smart contracts, as well as confining technological innovations within the scope of Brazilian public procurement. The research was carried out using bibliographic and documentary research, with the use of the inductive method to infer the conclusions pointed out. It concludes that the characteristics of Brazilian public procurement legislation make the adoption of more advanced technological solutions dependent on legislative changes and that smart contracts, in their most radical and innovative form, are incompatible with the regime of exorbitant clauses provided for in the legislation.
