espanolEn el contexto actual del Derecho existe una realidad desbordante denominada el nuevo Constitucionalismo, fenomeno complejo que irradia a todos los ordenamientos juridicos que forman parte de los sistemas juridicos anglosajon, romano germanico, islamico, etc. La referida realidad juridica obliga a los organos publicos a dar razones validas para que puedan decidir los conflictos intersubjetivos, incertidumbres juridicas, proteccion de derechos constitucionales, los ilicitos penales y demas que requieran solucion, por tanto, existe una elevada demanda de argumentacion juridica por parte de los justiciables. La argumentacion juridica es importante, pues constituye un requisito mas para que se pueda presenciar el referido fenomeno, debido que cuida la construccion del silogismo, otorga validez a los fundamentos esgrimidos y finalmente persuade a un publico determinado bajo ciertas reglas previas, es decir, se pasa del plano individual al plano social, para la legitimidad de la argumentacion juridica. La presente investigacion se dara en los Juzgados Mixtos de la Corte Superior de Justicia de Puno – sede Puno, centrandonos en las sentencias expedidas en los procesos de amparo, cuyos objetivos se encuentran direccionados a la verificacion de si las sentencias se encuentran adecuadamente argumentadas conforme a la teoria estandar de la argumentacion juridica dentro del neoconstitucionalismo. Los metodos que se utilizaran son el argumentativo, deductivo, analitico y sintetico. EnglishIn the current context of Law there is an overwhelming reality called the new Constitutionalism, a complex phenomenon that radiates to all legal systems that are part of the Anglo-Saxon, Romanic, Germanic, Islamic, etc. legal systems. The aforementioned legal reality obliges the public bodies to give valid reasons so that they can decide intersubjective conflicts, legal uncertainties, protection of constitutional rights, criminal offenses and others that require solution, therefore, there is a high demand for legal argumentation by of the justiciables. Legal argumentation is important, as it constitutes a further requirement for the aforementioned phenomenon to be witnessed, because it takes care of the construction of the syllogism, gives validity to the fundamentals used and finally persuades a specific audience under certain previous rules, that is, it passes from the individual to the social level, for the legitimacy of legal argumentation. The present investigation will be given in the Mixed Courts of the Superior Court of Justice of Puno - Puno headquarters, focusing on the sentences issued in the amparo proceedings, whose objectives are directed to the verification of whether the sentences are adequately argued according to the standard theory of legal argumentation within neo-constitutionalism. The methods that will be used are argumentative, deductive, analytical and synthetic.
