LOS FUNDAMENTOS FILOSÓFICOS Y JURÍDICOS QUE JUSTIFICAN EL RECONOCIMIENTO DE LA MADRE TIERRA COMO SUJETO DE DERECHO

espanolEste trabajo desarrolla los fundamentos filosoficos y juridicos para adjudicar y reconocer derechos a la Madre Tierra, concretamente, se plantea la necesidad de que la Madre Tierra sea reconocida como sujeto de derechos, sin embargo, al respecto, existen algunas dudas sobre su viabilidad y, especialmente, sobre los fundamentos que la avalan, por esa razon, el objetivo de la investigacion fue establecer las posturas – o corrientes– filosoficas y juridicas que fundamentan el reconocimiento de la Madre Tierra como sujeto de derechos. Los metodos empleados fueron el analisis documental y hermeneutico, a su vez, la tecnica usada fue la observacion-directa que consistio en analizar la bibliografia pertinente al tema de estudio. Finalmente, los resultados a los que se han arribado son: (i) las posturas filosoficas como filosofia de la liberacion y la filosofia andina, y, (ii) las posturas juridicas como el derecho indigena y el pluralismo juridico, en ambos casos, fundamentan y justifican el reconocimiento de derechos a la naturaleza, a su vez, promueven el transito del antropocentrismo –centralidad del hombre y su dignidad– hacia el biocentrismo –centralidad de la vida y el respeto de la diversidad de especies–. Con lo cual queda expuesta la presencia de fundamentacion filosofica y juridica para el reconocimiento de la madre tierra como sujeto de derechos. EnglishThis work develops the philosophical and legal foundations to award and recognize rights to Mother Earth, specifically, the need for Mother Earth to be recognized as a subject of rights is raised, however, in this regard, there are some doubts about its viability and, especially, on the foundations that support it, for that reason, the objective of the research was to establish the philosophical and legal positions - or currents - that support the recognition of Mother Earth as a subject of rights. The methods used were documentary and hermeneutical analysis, in turn, the technique used was direct-observation, which consisted of analyzing the relevant bibliography to the subject of study. Finally, the results that have been reached are: (i) the philosophical positions such as the philosophy of liberation and the Andean philosophy, and, (ii) the legal positions such as indigenous law and legal pluralism, in both cases, support and they justify the recognition of rights to nature, in turn, they promote the transition from anthropocentrism - centrality of man and his dignity - towards biocentrism - centrality of life and respect for the diversity of species. With which the presence of philosophical and legal foundations for the recognition of mother earth as a subject of rights is exposed.
