Resume : Cette contribution presente le cours sur les institutions primitives dispense par l'historien du droit Jacques Flach au College de France entre 1892 et 1904. Elle insiste sur la singularite de son approche historique et comparative. Soucieux d'etudier les institutions en contexte, il propose une interpretation inedite de la feodalite, ambitionne d'ecrire une histoire globale du droit et cherche a restituer l'alterite institutionnelle des societes primitives. Flach est ainsi l'un des premiers a enseigner en France l'anthropologie sociale et juridique. Abstract : This paper presents Jacques Flach's College de France course in primitive law, which he taught from 1892 until 1904. It insists on the specificity of his historical and comparative approach. Ever attentive to studying institutions in their context, Flach proposes an innovative interpretation of feudalism, seeks to write a global history of law and endeavours to stress the institutional alterity of primitive societies. Flach is therefore among the first scholars to teach social and legal anthropology in France.
