The following article has the objective of showing some considerations about the typicity of bullying in Ecuadorian legislation. In line with this, the assumed methodological strategy is based on research methods: documentary, historical-logical, hermeneutic and analytical-synthetic review. On this basis, the findings make it possible to assert that, although steps have been taken in Ecuador to prevent workplace harassment and introduce instruments for its eradication, there is still a void in the criminal legal order that typifies this behavior and decrees sanctions for the stalker. Likewise, restorative and retributive actions of claim to the harassed are established.
