A evolução do contraditório na jurisprudência e no direito processual civil brasileiro

EnglishThe present text / article tries to analyze the conceptual evolution of the contradictory before the Brazilian courts and throughout the 30 years of validity of the Constitution of the Republic of Brazil. The problem that we intend to discuss in the text is precisely the theoretical delay developed by the Brazilian judiciary over the course of 30. In order to find paradigmatic decisions, we intend to demonstrate that the judiciary does not guarantee the contradiction in an effective way. In order to arrive at the answer we use the methodology of bibliographical revision and jurisprudence portuguesO presente texto/artigo busca analisar a evolucao conceitual do contraditorio junto aos tribunais brasileiros e ao longo dos 30 anos de vigencia da Constituicao da Republica do Brasil. O problema que se pretende discutir no texto e justamente o atraso teorico desenvolvido pelo judiciario brasileiro ao longo de 30 anos. Buscando decisoes paradigmaticas pretendemos demonstrar que o judiciario nao vem garantindo o contraditorio de forma efetiva. Para chegar na resposta utilizamos a metodologia de revisao bibliografica e da jurisprudencia
