This article is intended to explain how the mental incapacity exemption, understood as the lack of criminal responsibility due to a mental disorder, may exert a negative influence on the individuals´ subjectivity. In that sense, on the basis of the postulates of the subjective assert, assuming the relevance to maintain a person´s psychological balance, this work seeks to clarify the potential effects of such exemption on human health. Thus, elaborating on the contributions coming from the criminal dogmatic and the psychoanalysis, and keeping a strong focus on a mental health model respectful of the singularity of each person, the article is devoted to show how mental incapacity exemption might be illegitimate. Within that context, the argentine legal system will be taken as a case study in order to analyse the dysfunctionality of the criminal law of mental incapacity.
