This work intends to evaluate the suitability and the legal possibilities to bring about flexibility to radio spectrum regulation in Brazil, specifically under the perspective of the public property regime. It starts off from a conceptual and comparative analysis of spectrum, and from the historical context which has set forth its regulatory premisses, and seeks to identify the current model’s ratio and deficiencies. Next, it works on the development of a public sphere theory that stimulates a democratic plurality in this flexibilization process. Following, it analyses public property issues in the context of a modern legal regime, which mostly accounts for the functionality of public utilities. The work examines the guaranties for the protection of fundamental rights related to the use of radio spectrum. It deals with the problem of exactitude in defining property rights in the allocation of spectrum, and strives to assess the efficacy of an administrative process theory as the foundation to regulate the radio spectrum in a scenario that contemplates private allocation of spetrum and the protection of the public interest. The objective is to aide in the refinement of guidelines and the establishment of safe rules to eventual regulatory changes in use and allocation of spectrum in Brazil. The study fills the void of a consistent study on the theme of spectrum reform, since it brings forth into consideration the most recent developments in public property management while aiming to secure the public interest and allowing for spectrum property, while still under strong public property and governance, to be bear more similar traits to a private property regime.
