Parliamentary immunity deserves study after fourteen years from the alteration provided by Constitutional Amendment n. 35/2001, this is due to the increase of precedents from the Federal Supreme Court on the subject, focusing on the adjudication decision for pre-trial detention of Senator Delcídio Amaral, analyzing the thesis adopted in that case, especially in the light of systematic interpretation. As for the methodology, this article was based on bibliographical and documentary research (rulings from the Superior Courts) making use of inductive, deductive, socio-historical and dialectical methods.
