O presente estudo tem como objeto a analise de uma decisao recente e inedita no pais que proporcionou uma nova interpretacao da questao da punibilidade indigena. Trata-se de acordao confirmatorio pela segunda instância do Tribunal de Justica de Roraima de sentenca de juiz de primeiro grau realizada nos autos do Processo No 0090.10.000302-0. Inicialmente, e feita uma abordagem introdutoria relacionando Direito Penal, Cultura e Poder. Em seguida, e abordada a nova valorizacao da cultura indigena como fruto de uma visao multiculturalista consagrada pela Constituicao Federal de 1988. Apos, analisa-se superficialmente a resposta penal como fruto de uma manifestacao cultural, inclusive na propria tarefa de interpretacao do Estatuto do Indio no direito penal ordinario e, no caso em analise, a punicao do indio pela comunidade indigena Monoa a luz da Convencao 169 da OIT, tratado de direitos humanos que o Brasil e signatario . Busca-se compreender juridicamente como tal decisao se fundamenta inclusive com paralelos no direito comparado. Por meio de uma metodologia qualitativa baseada em pesquisa bibliografica, analisa-se, portanto, uma decisao inedita atraves do reconhecimento intercultural que implicou em um dos direitos fundamentais mais importantes do individuo: a liberdade. Abstract: This study aims to promote an object analysis of a recent and unprecedented decision in the country that provided a new interpretation of the issue of indigenous criminal liability. This is the second instance confirmatory judgment of the Court of Justice of Roraima judge sentence of first degree held in the file of Case No. 0090.10.000302-0. Then, the new appreciation of indigenous culture is approached as the result of an multiculturalist view enshrined in the Federal Constitution of 1988. After that, we analyze superficially the criminal response as the result of a cultural practices, including in the Indian Statute of the interpretation task called The Ordinary Criminal Law and, in this case, the punishment of the Indians by the indigenous community Monoa in accordance with ILO Convention 169, a human rights treaty to which Brazil is a signatory. It seeks to understand legally how such a decision is based even on parallels in comparative law. In addition to the positive law, an approach is taken to understand the decision under study by overcoming the ethnocentrism of the official criminal law and the recognition of interculturality. Through a qualitative methodology based on bibliographical research, we therefore analyze an unprecedented decision through an intercultural recognition that implied one of the most important fundamental rights of the individual: freedom.
