Pluralismo jurídico en la República Popular China: punto de encuentro de la diversidad étnica y jurídica

Experts point out that in order to understand current Chinese legal system we must comprehend how their societies have created its political and legal thought for centuries. This article will analyze the historical development of the formation processes of China’s current legal pluralism; from the last dynasty to today, within a big frame, it will show how the political and legal center has deal with the peripheral diversity. Because legal pluralism enables us to see historical and regional differences as well as the work of the Chinese Communist Party, supported by the questioning of sinocentrism, this paper will show that in current People’s Republic of China’s territory have coexisted multiple cultures with different legal traditions, but an approach based on formal analysis or the legal-historical state’s narrative is not enough to portray this complex panorama. The study of Chinese law contributes to open up the panorama of the world’s legal epistemological diversity.
