The International Criminal Court has generated great expectations all over the world regarding the penalization of violations of international humanitarian law and human rights, committed by individuals residing in the State Parties that subscribed to and ratified the Rome Statute. To debate here is understood as: ‘an act of reason’; ‘to think deeply and methodically about a particular subject in the essence of either supporting or refuting another’s opinion’. Taking this into account, the objective of this article is to discuss the aforementioned Court’s impact on the evolution of international humanitarian law and human rights in Colombia; to demonstrate the origins of the International Criminal Court, the implementation of the Rome Statute in Colombia. In this perspective, they are studied the origins of the International Criminal Court, the implementation of the Rome Statute in Colombia, the importance of the constitutional block, the reasons for its competency, the palpability of the State in regards to Colombian cases, and finally to realize an analysis of the colloquially named Peace and Justice Law.
