Despite the normativity of international law aimed at decolonisation Australia retains firm colonial rule over the original owners of the continent. Among the many ways in which colonial rule is maintained is the legal control over who can be an Aboriginal Australian. Australian legal institutions fail to relinquish control in favour of self-determination in accord with international standards and instead apply a descent test. This descent test is sociobiological because it privileges biological criteria over the principle of self-determination.
