This work criticizes Brazil ́s electoral judicial procedure “praxis” that still guides itself by the individual system, subjectivist, distant from the democratic legal procedure and from the collective rights of the field. Likewise, because reticent about the evidence destination in order to structure the procedure aiming the reliable reconstruction of legal facts, utilizing means reprimanded by the “garantismo” (protection of civil liberties), for example, the use of personal testimony as evidence and plea bargains to confirm convictions. The methodology utilized to reach the shown conclusions consists in the revision of jurisprudence and field specific literature, making salient the uncritical state of the field and it adherence to the “statu quo”, offering immediate proposals to be involved in reality, showing the valuableness of the present work by the current moment in Brazil since new electoral law changes are announced near the national elections.
