This study worries to explore the existence of a theoretical body referring to universal thoughts and historic tendencies that falls of triumphant way on the western civilization. The basic regulations and rules and own legacies of cultural and legal type of one civilization transmit and adapt in diverse places of the world, until taking the form from a civilization. The Islamic civilization is formed by a series of referring symbolic and independent cognitive relations, that beyond adapting or molding themselves to a cultural and historical reality, also are proponents materials that helps to forge this civilization. The intercivilizations loads of meaning, concepts and symbols generate flows and ebb tides that emphasize the necessity of international social relations, by diverse means, mainly the one of the legal system. In this essays it is tried to reflect the relations between the right and the functional religion, the religion professed in right, and the preaching right of the religion. The foundation of an independent community of Islamic right will be treated within the legal-political matrix and will glimpse the religious question like creator and source of the right, that extends towards one more an ampler community, simultaneously universal.
