El agua como derecho fundamental y su protección jurídico-penal

Water as a fundament right and its penal law protection. This document is based on the constitutional value that has being given to water in the sense of use and enjoyment of people however this guarantee is not reflected between the actual generation. On the contrary water use at home is not controlled by the authorities its indiscriminate abuse affects this vital liquid because of this irresponsibility and the real and imminent risk for future generation to remain without water. We analyze the possibility to elevate to criminal state the voluntary action of the agent or person who does not use the water in an appropriate way.
