6292 sayılı yasa hakkında düşünceler

Some considerations on the law with the number 6292 Abstract : The problem of recycling of the land which is taken out of the forest interests public during  10 years.  In order to solve this problem the law with the number 6292 was accepted and issued in the gazette with the number 28275 in April 26 th , 2012.  In this paper after the historical development of process of taking out of the forest is briefly referred , the regulations concerning the law about supporting the development  of  forest  villagers and recycling of lands which are taken out of the forest  on behalf of treasury and selling the agricultural lands which are belongs to the treasury  are examined.  Otherwise the compatibility of the law with the constitution and whether it solves the problem  are also examined. Keywords: Losing of the forest character, taking out of the forest, cadastral survey of  using types, right ownership 6292 sayili yasa hakkinda dusunceler Ozet : Bu makalede; orman disina cikarma isleminin tarihi gelisimine kisaca deginildikten sonra son 10 yil boyunca kamuoyunu mesgul eden orman disina cikarilan alanlarin degerlendirilmesi meselesini cozmek amaciyla kabul edilen ve 26/04/2012 tarih, 28275 sayili Resmi Gazetede yayinlanan 6292 sayili “Orman Koylulerinin Kalkinmalarinin Desteklenmesi ve Hazine Adina Orman Disina Cikarilan Yerlerin Degerlendirilmesi ile Hazineye Ait Tarim Arazilerinin Satisi Hakkinda Kanun” ile getirilen duzenlemeler ele alinarak bu duzenlemelerin Anayasaya uygunlugu ve sorunu cozup cozemeyecegi irdelenmistir.
