Oz: Şer’i hukumde degisim konusu bircok calismada usuli temelinden bagimsiz olarak ele alinmaktadir. Bu konu, olguda degisimi esas alan ve her bir vakianin alacagi hukmun illetini inceleyen tahkiku’l-menât yontemi kapsaminda ele alinmalidir. Hukumde degisim kavrami, gercek anlamda bir degisimi ifade etmemektedir. Bu degisimin ispati icin referans gosterilen tum arguman ve ornekler bu anlamdaki degisimi degil, hukme konu olan cuz’i hâdiselerdeki degisimi ifade etmektedir. Cuz’i hadiselerin icerdigi tikel durumlar hukumlerin baglandigi illetlere tekabul etmektedir. Hukumler illetlerle birlikte deveran ettigi gibi, bu tikel durumlarla birlikte de deveran etmektedir. Karâfi (o. 684/1285)’den Ibn ‘Âbidin (o.1252/1836)’e kadar bu konuda soz soyleyen fakihler ahkâmin degismesinden degil, ahkâma tekabul eden mezkur durumlarin degisiminden bahsetmektedirler. A New Approach to the Concept of a Change in the Judgement Abstract: The subject of ‘change in Shari ’a decision’ is covered independently in many studies from the pertinent fundamental Shari’a law. This subject has to be evaluated under the heading of ‘tahqiq al-mana’t which specifically examines a change in phenomenon and serves to determine the reason (illat) on which the decision for each daily-life case is based on. The concept of a change in the judgement does not mean a change in fundamental Shari’a law. All of the arguments as well as examples referred to for proving a ‘change in Shari’a decision’ only mean a change in daily-life individual cases, not a change in fundamental Shari law. Individual daily-life cases correspond to the Shar’i reasons on which decisions are based on. Decisions become different with reasons as well as with individual daily-life cases. All jurists from Karâfi to Ibn ‘Âbidin discuss a change in phenomenon, not a change in fundamental Shari’a law. Keywords: Change in decision, Change in fatwa, Real (ized) case, Tahqiq al-menât
