As Mudanças do Código de Processo Civil e as Consequências na Rescisão da Coisa Julgada

O Codigo Processual Civil de 2015 trouxe importantes e significativas mudancas ao bojo do processo. Sua sistematica, que visa otimizar o tempo de tramitacao da acao, dando substância ao principio da razoavel duracao do processo, implementou, por exemplo, o julgamento parcial do merito. O presente trabalho visa, portanto, analisar as mudancas implementadas pelo novo codex que guardam relacao com o instituto da coisa julgada material e suas implicacoes imediatas nas hipoteses de cabimento da Acao Rescisoria. Its systematic, aiming the optimization of the proceedings of a lawsuit, giving substance to the principle of the reasonable duration of the procedure, implementing, for example, the partial judgment of the merit of the cause. The present paper aims, therefore, to analyze the changes of the changes implemented by the new codex that are related with the institute of the res judicata and its direct implications in the hypothesis of suitability of the Rescissory Actions.
