The status of CMS concerning the 2009 run and the first data recorded at 7 TeV in 2010 is reported. A summary of the LHC and CMS detector performance is given and the first CMS results are presented. In particular, emphasis will be given to low-pT QCD Physics including charged hadron spectra, the measurement of Bose-Einstein (BEC) and angular Correlations, and of underlying event properties
