This note analyses the E uropean C ourt of H uman R ights' G rand C hamber judgment in A l‐ K hawaja and T ahery v U nited K ingdom , and gives it a cautious welcome. The note suggests how E nglish C ourts might respond to the judgment and concludes by assessing justifications for strong confrontation rights and the wider political context of the G rand C hamber's decision.
