Resumen : Partiendo de que el Derecho esta formado por dos elementos, orden y justicia, el articulo indaga acerca de que concepcion de orden -la realista de Heraclito o la idealista de Parmenides- se acomoda mejor a la naturaleza compleja del mundo y, por tanto, del propio Derecho. Para ello y en primer lugar, llama la atencion sobre elementos del contexto de estos pensadores habitualmente poco destacados. A continuacion, expone los elementos esenciales de ambas propuestas a juicio del autor. Por ultimo, senala algunas consecuencias de caracter juridico derivadas de ambos paradigmas. Abstract : Departing from the topic that Law is made up of two elements, justice and order, this article inquires about which conception of order would be most fitted to complex nature of world and Law, either Heraclitus’ realist one or Parmenides’ idealist one. First, it highlights different facts pertaining to these philosophers context that are not normally taken into account. Next, it presents both proposals main traits. Finally, it points out some legal consequences derived from both paradigms.
