Un mois après les attentats d’août 2005 au système de transport public de Londres, le premier ministre britannique, Tony Blair, a convoqué une conférence de presse pour annoncer une série de mesures, à la fois administratives et législatives, pour accroître l’ampleur de sa campagne contre le terrorisme. Blair a énuméré dix mesures, y compris la détention étendue de suspects, des limites au droit d’asile, l’augmentation des accords d’extradition avec d’autres pays, ainsi que l’établissement d’une nouvelle infraction dans le cas où il y a « approbation ou glorification du terrorisme ». Cette série de mesures allait manifestement bien au-delà du simple but de renforcer et d’étendre les moyens d’interrogation, d’emprisonnement ou de déportation. Leur intention ne se limitait pas à la préemption ou la punition. Au coeur de celle-ci, se trouvait un message sur la nature de la société britannique - sur ce que veut dire, aujourd’hui, la citoyenneté en Grande-Bretagne. Blair a résumé sa position comme suit : « Ceux qui veulent être des citoyens britanniques devraient partager nos valeurs et notre style de vie. » Il y aurait, disait Blair, « un test de citoyenneté britannique. » En pratique, une telle proposition pose des difficultés de mise en oeuvre. Elle soulève notamment des questions juridiques complexes, parmi lesquelles la dimension internationale de la déportation. Ceci dit, la légalité de la proposition n’est pas le sujet de ce texte ; celui-ci s’intéresse plutôt aux éléments constitutifs de la citoyenneté que reconduit cette initiative du gouvernement britannique. Dans cette perspective, il tentera de répondre aux questions suivantes : Qui est citoyen ? Qui a droit à la citoyenneté ? Qu’est-ce que l’État peut demander aux citoyens ? Qu’est-ce que les citoyens peuvent demander à cet État ?Barely a month after the bombing of the London public transport system in August 2005, the British Prime Minister, Tony Blair, made public a number of legal and bureaucratic measures to sustain his ongoing fight against terrorism. Blair introduced ten measures, including the prolonged detention of suspects, new limits to the rights of refugee, bilateral and multilateral agreements on extradition with other countries, as well as the enactment of a new law regarding the alleged support and glorification of terrorist acts. All of these measures evidently go well beyond the simple task of reinforcing and expanding standard means of interrogation, imprisonment and deportation. Their intent is not limited to pre-emptive and punitive actions. At the heart of these measures lies a redefinition of the British society, i.e. the very nature of citizenship in contemporary Great Britain. From now on, said Prime Minister Blair, there would be a “test of British citizenship”. Though such a test entails complex legal issues, they are not the focus of the following paper. Rather, its emphasis is on the meaning of this (re)definition of citizenship and its consequences for democratic governance, through the following questions: Who is a citizen ? Who has a right to citizenship ? What can a democratic (post)modern state ask from its citizens ? What can citizens ask from their state and government
