La liberté d’information constitue un principe de droit international consacré dans plusieurs instruments internationaux. De même, la plupart des constitutions nationales accordent à la liberté d’information le statut de règle supra-législative. La liberté d’information n’est évidemment pas absolue et doit, parfois, céder le pas à des intérêts concurrents. L’auteur examine les critères propres à assurer l’équilibration de la liberté d’information et des droits qui lui sont concurrents. Cet exercice d’équilibration est souvent présenté dans la jurisprudence et la doctrine, tant nationales qu’internationales, comme une forme achevée d’objectivité. Cette prétention à l’objectivité soulève des difficultés pratiques et théoriques. Au plan pratique, l’auteur démontre que la liberté d’information est loin d’avoir un sens unique en droit international. Bien que la plupart des pays souscrivent à la liberté d’information, chacun l’aménage à sa façon. De même, en droit national, le sens et la portée de la liberté d’information sont tributaires de facteurs contextuels qui amenuisent sérieusement la nature objective de l’exercice d’équilibration auquel se livrent les tribunaux. Au plan théorique, l’auteur souligne que le libéralisme juridique nie, en quelque sorte, cette prétention à l’objectivité puisque ses deux postulats fondateurs, l’autonomie de l’individu et le consentement de ce dernier à l’établissement de tout ordre social, consacrent la subjectivité des valeurs.Freedom of information is a guiding principle of international law and is enshrined in many international agreements. Additionally, the constitutions of many countries accord freedom of information a supra-legislative status. However, it should be noted that freedom of information is not absolute and must on occasion cede its place to competing interests. The author examines the criteria necessary to ensure that an acceptable equilibrium is established between the right of freedom of information and other competing rights. Previous national and international studies of legislation, jurisprudence and doctrine have professed that such criteria result in an objective standard. However, it should be noted that such a position raises both theoretical and practical difficulties. On a practical level the author demonstrates the multitude of definitions and approaches to the term "freedom of information". Freedom of information is subject to a variety of internal political and social factors which may have an impact upon judicial determinations as to which information is publicly accessible and which is not. On the theoretical level the author emphasizes that the doctrine of judicial liberalism would tend to contradict any finding of objectivity. Such a contradiction finds its roots in the belief that the autonomy of the individual and its consent towards the establishment of social order its necessarily decree the subjectivity of criteria and values
