L’objectif de la présente étude est de démontrer certaines problématiques entourant l’adoption nationale en droit français et québécois, particulièrement en ce qui concerne l’établissement du secret de la filiation d’origine de l’enfant. L’étude se limite à l’adoption prononcée à la suite du consentement du titulaire de l’autorité parentale. En guise d’introduction, l’auteure relate brièvement l’évolution historique du phénomène de l’abandon des enfants et de l’adoption, afin de mieux comprendre les motifs qui ont conduit le législateur à instaurer le secret autour de cette institution.La première partie traite de l’établissement de la confidentialité entourant la naissance ou l’adoption de l’enfant. Dans un premier temps, on y aborde la possibilité pour les femmes enceintes de se prévaloir du secret de leur identité au moment de l’accouchement. Cette opportunité, reconnue en France mais ignorée par le droit québécois, a pour conséquence d’interdire toute action en recherche de maternité et prive ainsi l’enfant de la possibilité d’avoir accès à ses origines. Même si ce droit existe en France depuis des siècles, il suscite toujours de vives controverses. Dans un deuxième temps, il est question de l’établissement du secret de la filiation au moment du consentement à l’adoption de l’enfant par le titulaire de l’autorité parentale. On remarque des différences importantes à ce chapitre entre les législations française et québécoise. En France, on permet le choix du parent adoptif par le parent biologique lorsque l’enfant est âgé de deux ans et plus, ce qui implique nécessairement que les parties se connaissent. Le droit québécois est beaucoup plus restrictif et réserve cette possibilité à la famille immédiate de l’enfant. Dans les autres cas, les parents biologiques et adoptifs sont, en principe, des étrangers, d’où l’instauration du secret de l’adoption. De plus, en France, les parents ont la possibilité de demander que l’état civil de l’enfant soit tenu secret, s’il est âgé de moins d’un an lorsqu’ils le remettent aux intervenants sociaux en vue de son adoption. Ce droit existe pour les parents même si l’enfant n’est jamais adopté. Au Québec, seul le jugement d’adoption a pour conséquence de changer la filiation d’origine de l’enfant.La deuxième partie aborde la possibilité de déroger à la confidentialité de l’adoption. Elle traite des moyens de déroger aux règles de l’adoption, notamment, par le rattachement illicite de l’enfant au futur père adoptif. L’utilisation de l’adoption dans cet objectif a été mis en lumière par la jurisprudence française dans les cas où on a eu recours aux services d’une mère porteuse. Cependant, les mêmes problèmes se rencontrent au Québec, malgré des textes législatifs différents. L’auteure aborde également la reconnaissance du droit de l’adopté d’avoir accès, dans certaines circonstances, aux informations relatives à sa filiation d’origine. Or, on constate dans les deux pays, que la tendance actuelle s’oriente vers un accès plus facile aux informations contenues dans les dossiers d’adoption.The purpose of this paper is to point out some of the problems occurring under laws governing adoptions in France and in Québec; more particularly with regards to rules established in relation to secrecy surrounding filiation. This study is limited to adoptions carried out with the consent of the person having parental authority. A brief outline of the history of child abandonment and adoption is presented by the writer in order that one may better understand the reasoning that prompted the lawmakers to institute the secrecy provisions relating to adoption.Part one of the paper deals with the establishment of the confidentiality rules surrounding the birth or adoption of a child. It starts by discussing the measure, available under French law, that allows a pregnant woman to insist that her identity be kept secret at the time of delivery. Well established in France, this privilege is not recognized under Québec law. The effect of this law is to prevent an action in declaration of maternity and it therefore deprives the child of any possibility of gaining access to his familial origins. Although this right has existed for centuries, it still remains an issue of debate in France. The second question examined relates to the establishment of secrecy concerning filiation at the time the person having parental authority consents to the adoption of a child. Significant differences between French and Québec law are noted. French law allows the biological parent to choose the adoptive parent when the adoption involves a child of two years of age or more. Of necessity, this implies that the parties know each other. Under Québec law, this may occur only within the child's immediate family. In all other adoptions in France, the biological and adoptive parents are, in principle, strangers and the rule of secrecy prevails. Moreover, parents in France who place their children aged less than one year in the hands of a social services agency for the purpose of adoption may insist that the child's civil status be kept secret. French parents enjoy this right even if the child is never adopted. Under Québec law a child's original filiation may only be changed by way of an adoption judgment.The second part of the paper discusses the possibility of derogating from adoption confidentiality rules. Certain illegal means used to circumvent the rules, notably the practice of falsely creating a connection between the child and the prospective adoptive father are examined. Use of this stratagem has come to light in French jurisprudence in cases involving the services of a surrogate mother. Similar problems are, however, encountered in Québec, despite textual differences in the laws of France and Québec. The writer also touches on recognition of the adoptee's right under certain circumstances to have access to information regarding his or her family background. Currently, in both France and Québec, there is a tendency toward facilitating access to information contained in adoption records
