Quand les Européens sont arrivés en Amérique du Nord, les peuples autochtones s’y trouvaient déjà et vivaient en sociétés organisées comme ils l’avaient fait pendant des siècles. C’est ce fait, par dessus tout, qui distingue les aborigènes des autres minorités du pays et qui commande leur statut constitutionnel particulier. Les droits ancestraux reconnus et confirmés à l’article 35(1) doivent donc tendre à concilier la préexistence des sociétés autochtones avec la souveraineté de l’État. Or, pour les juges de la Cour suprême, cette conciliation des intérêts en présence passe par un dosage méticuleux entre les valeurs fondamentales des autochtones et les valeurs démocratiques d’une communauté politique plus large à laquelle ils appartiennent. Ayant cet objectif à l’esprit, les juges ont défini la notion de droit ancestral comme une pratique, coutume ou tradition dont on peut démontrer de nos jours qu’elle prend sa source dans une activité qui fut exercée avant l’arrivée des Européens et qui a survécu à leur influence en ce qu’elle garde son caractère distinctif pour le groupe autochtone qui le revendique. En définissant ainsi les droits ancestraux, la Cour suprême évinçait par la même occasion de nombreuses revendications qui ne reposaient que sur une coutume, pratique ou tradition n’ayant qu’un caractère accessoire à la culture distinctive du groupe en question. Les arrêts Van Der Peet, Smokehouse et Gladstone, sont révélateurs de cette nouvelle orientation du droit autochtone, car pour la Cour suprême, si la protection des droits ancestraux est l’un des éléments nécessaires à cette conciliation, les limites imposées à ces mêmes droits en sont un autre si les objectifs visés sont suffisamment importants pour la communauté canadienne dans son ensemble.When the Europeans arrived in North America, the native people were already here and were living in organised societies as they had been for centuries. It is this fact, above all, which distinguishes the aboriginals from other minorities in this country and which commands a particular constitutional status. Ancestral rights, recognized and confirmed in Section 35(1), must therefore attempt to reconcile the said preexistence of native societies with that of state sovereignty. According to the Supreme Court of Canada, this conciliation of interests will be achieved through the careful analysis and weighing of the fundamental values of aboriginal people on the one hand, and the democratic values of the larger society to which they belong, on the other. With this objective in mind, the Supreme Court of Canada has defined the notion of native right as a practice, custom or tradition which can be shown today as having preexisted the Europeans, and which has survived the latter's influence in that the said practice, custom or tradition has maintained its distinctive character for the particular native group claiming it. In so defining aboriginal rights, the Supreme Court of Canada has thereby rejected numerous other claims for which custom, practice or tradition had but a peripheral or secondary importance to the group in question. The trilogy Van Der Peet, Smokehouse, and Gladstone reveals a new approach with respect to native rights. Indeed, for the Supreme Court of Canada, if the protection of aboriginal rights is one of the necessary elements in this conciliation, the limits imposed thereon are another since the objectives aimed are sufficiently important for the Canadian community as a whole
