Rendus à quelques semaines d’intervalle, le Renvoi relatif à la réforme du Sénat de même que le Renvoi relatif à la Loi sur la Cour suprême, art. 5 et 6 posent des limites importantes à l’action unilatérale d’Ottawa en matière de réforme des institutions, et ce, au nom d’un principe fondamental jouant un rôle matriciel dans l’interprétation de la procédure de modification constitutionnelle : le fédéralisme. À l’occasion de ces deux avis, la Cour a non seulement précisé le champ d’application des procédures multilatérales de modification de la partie V de la Loi constitutionnelle de 1982, mais elle a aussi tiré les conséquences qui s’imposent du principe fédéral. D’abord, sur le plan institutionnel, ce dernier principe constitue, non seulement une limite à l’action unilatérale d’Ottawa, mais aussi un facteur structurant l’ordonnancement juridique et un fondement à l’action de la Cour suprême du Canada. Puis, sur le plan du contenu du principe fédéral, la Cour suprême développe, à l’occasion des deux avis de 2014 relatifs à la procédure de modification, une réflexion plus formelle sur les dimensions consociatives du fédéralisme canadien dans le cadre desquelles la spécificité nationale du Québec et les arrangements spéciaux négociés en conséquence sont protégés, du moins partiellement, par la procédure de modification adoptée en 1982 sans l’accord du Québec. De ce fait, le principe fédéral s’impose comme un principe matriciel qui conditionne l’interprétation de la procédure de modification constitutionnelle et qui favorise le fédéralisme consociatif.Rendered a few weeks apart, the Reference re Senate Reform as well as the Reference re Supreme Court Act, ss. 5 and 6 impose significant limitations on the unilateral power of Ottawa to institute reforms, and this is done in the name of a fundamental principle providing a framework principle for the interpretation of the amending formula: federalism. In the two cases at hand, the Supreme Court not only clarified the scope of multilateral procedures required to amend part V of the Constitution Act, 1982, but it also underlined the limitations imposed by the federalism principle. First, at the institutional level, this principle constitutes not only a limit on unilateral action by Ottawa but also a factor structuring the legal system and a basis for action by the Supreme Court of Canada. In addition, with a view to the content of the federalism principle, the Supreme Court developed a formal analysis of the consociate dimensions of federalism in which Québec national specificity and the negotiated special arrangements are protected, at least partially, by the amending formula adopted in 1982 without Québec consent. Therefore, the federalism principle imposed itself as a framework principle guiding the interpretation of the amending formula and that weighs in the sense of consociate federalism
