Dans cet article consacré à l’étude des règles qui pourraient régir l’investissement étranger dans la future zone de libre-échange entre le MERCOSUR et la Communauté andine, l’auteure présente, dans une première partie, les développements qui ont mené à la signature de l’accord-cadre visant la création de cette future zone de libre-échange. L’étude de ces développements est importante pour établir les possibles répercussions que la signature de cet accord pourrait avoir sur le Canada et les autres pays d’Amérique latine qui participent avec ces deux groupes régionaux au processus de création de la Zone de libre-échange des Amériques.Dans une deuxième partie, l’auteure expose les caractéristiques particulières des régimes de protection et de promotion de l’investissement étranger établis au sein du MERCOSUR et de la Communauté andine. L’examen de ces règles est une démarche qui permettra d’établir que le Protocole de Colonia semble être le modèle que les pays membres du MERCOSUR et de la Communauté andine choisiront au moment d’établir les règles et principes applicables à l’investissement étranger au sein de cette future zone de libre-échange. La clarté et la transparence des règles contenues dans le Protocole de Colonia permettront, si elles sont retenues et appliquées, la croissance de l’investissement étranger au sein de cette future zone de libre-échange et la poursuite des efforts en vue de libéraliser les échanges et l’investissement étranger aux plans régional et hémisphérique.In this paper, which is concerned with the rules that might govern foreign investment in the future free trade area between MERCOSUR and the Andean Community, the author begins by describing the developments leading up to the framework agreement for the creation of the new free trade area. The study of these developments is important in establishing the potential repercussions that the signature of such an agreement could have for Canada and the other Latin American countries involved with these two groups in the process of creating the Free Trade Area of the Americas.In the second part of the paper, the author identifies the specific characteristics of the foreign investment protection and promotion systems currently existing in MERCOSUR and the Andean Community. An understanding of these rules is important, since it suggests that the Colonia Protocol appears to be the model that the MERCOSUR and Andean Community member countries will prefer when establishing the rules and principles governing foreign investment in the new free trade area. If the Colonia Protocol rules are used, their clarity and transparency will help increase foreign investment in the new free trade area, and will also favour ongoing efforts to promote free trade and foreign investment at the regional and hemispherical levels
