La rupture d’un contrat peut survenir pour cause d’inexécution desobligations contractuelles. Il s’agit alors d’une rupture-sanction qui a pour but demettre un terme à la relation contractuelle. Ce droit de rompre, comme tout autre,n’est pas sans limite et doit être exercé selon les exigences de la bonnefoi.Le présent texte jette un regard sur certaines facettes du rôle de la bonnefoi dans un contexte de rupture du contrat. Il convient premièrement de s’interrogersur la possibilité d’invoquer un manquement à l’obligation de bonne foi pour fonderle droit à la résolution de contrat. Malgré l’origine légale de l’obligation debonne foi, celle-ci fait partie du cadre contractuel. L’auteur conclut qu’unmanquement aux exigences de la bonne foi lors de l’exécution du contrat constitueune faute contractuelle qui donne ouverture à la résolution du contrat.Deuxièmement, l’examen des conditions de fond du droit à la résolution amènel’auteur à souligner que l’obligation de bonne foi pourrait permettre d’offrir unesolution au problème de l’inexécution anticipée. Finalement, l’examen de la mise enœuvre du droit de rompre permet de constater qu’au stade de la demeure, la bonne foiexige que la dernière chance qu’a le débiteur pour s’exécuter ne soit pas illusoireet que de façon générale, le principe de la bonne foi sert à contrôler lecomportement du créancier et du débiteur dans l’exercice de la résolution ou de larésiliation du contrat.Inexecution of contractual obligations can be the cause for breach ofcontract. It then can be called a breaking down penalty putting an end to thecontractual relationship. This right to resolution or resiliation as any other isnot without limit and must be used according to the requirements of goodfaith.The purpose of this exercise is to look at some aspects of the principle ofgood faith in the context of the breach of contract. First, we must study and see ifa right to obtain the resolution or resiliation can be supported by any failure tothe obligation of good faith. This principle despite its legal origin is part of thecontractual frame. A breach of the good faith obligation at the time the contract isperformed is a contractual breach allowing resolution of it, according to theauthor. Study of essential requirements to resolution permits a conclusion that thegood faith obligation can support a solution to anticipatory breach. Examination ofthe procedure of how to exercise the right to resolution and resiliation shows thatgood faith, at the default stage must allow a non illusionary last chance to thedebtor to execute his obligations. The creditor's and the debtor's behaviours areregulated according to said principle in exercising resolution or resiliation ofcontract
