Alors qu’étymologiquement, le mot domaine (dominium) signifie la puissance de la personne sur les choses et le mot propriété (proprietas), l’objet soumis au domaine, c’est pourtant le second qui a été retenu par les artisans de la codification du droit privé français pour désigner le « droit de jouir et de disposer des choses de la manière la plus absolue ». La variation de sens entre les étymons et le vocabulaire législatif français invite à se pencher sur révolution sémantique de domaine et de propriété depuis leur apparition dans la langue française et à s’interroger notamment sur les motifs qui ont dicté le choix terminologique de l’article 544 du Code civil. Le premier constat est la polysémie acquise par le terme propriété, inscrite dans le Code civil et aujourd’hui encore de mise. En effet, s’il conserve un sens objectif si la propriété continue de désigner la chose appartenant en propre à quelqu’un, le mot s’enrichit aussi sous l’ancien droit d’une acception subjective, voire d’une dimension potestative. Résultat en partie de l’élaboration du concept de droit subjectif, le fait que la propriété exprime l’appropriation sous l’angle actif du sujet propriétaire ne suffit pas à expliquer la consécration du mot dans l’article 544. Les principales significations acquises avant la Révolution par le mot domaine y sont aussi pour beaucoup. En effet, son sens premier de héritage, fonds, son sens absolu de biens publics, son pouvoir d’évocation de la féodalité témoignent de son incompatibilité avec l’idée d’un droit du particulier de disposer de ses choses.Whereas etymologically, the word domaine (dominium) means the power of the person on the things and the word propriété (proprietas), the object subjected to the domaine, it is however the second who was retained by the craftsmen of the French private law codification to indicate the "right to enjoy and dispose of things in the most absolute manner". The variation of meanings between etymons and French legislative vocabulary invites to consider the semantic evolution of domaine and propriété since their appearance in the French language and to wonder particularly about the reasons which dictated the terminological choice of section 544 of the Civil Code. The first report is the polysemia acquired by the term propriété, registered in the Civil Code and today still of setting. Indeed, if it preserves an objective meaning, if propriété continues to indicate the thing belonging to somebody, the word also grows rich under the Ancien Régime of a subjective meaning, even of a potestative dimension. Result partly of the development of the concept of subjective right, the fact that propriété expresses the appropriation under the active angle of the subject owner is not enough to explain the consecration of the word in section 544. The main significances acquired by the word domaine before the French Revolution are there also for much. Indeed, its first meaning of good, estate, its absolute meaning of public goods, its capacity of evocation of feudality testify to its incompatibility with the idea of a right of the private individual to dispose of his things
