La Déclaration de Vienne, adoptée le 25 juin 1993 par la Conférence mondiale sur les droits de l’Homme, consacre juridiquement le principe d’indivisibilité des droits et libertés fondamentaux et son corollaire, l’absence de hiérarchie juridique entre ces mêmes droits et libertés. Cette consécration déclaratoire internationale a par ailleurs trouvé une résonance directe en droit canadien, à l’intérieur duquel la Cour suprême a très clairement intégré ce principe dans l’arrêt Dagenais, rendu un peu moins d’un an plus tard. Or, pour toute cohérente qu’elle puisse être sur un plan idéologique ou philosophique, l’élimination (ou l’interdiction) de toute hiérarchie juridique entre droits fondamentaux semble très peu susceptible d’être mise en œuvre concrètement. En effet, la nature toute particulière des objets de protection consacrés par les textes juridiques sur les droits fondamentaux, inextricablement liée à une certaine conception morale de la société, nous semble impliquer l'établissement, au fil du temps, d’une certaine hiérarchisation juridique entre droits et libertés fondamentaux au sein des nombreux régimes juridiques composant la société internationale actuelle. Sans aller jusqu’à affirmer que le principe de non-hiérarchie juridique entre droits fondamentaux doit être complètement mis à l’écart, les auteurs démontrent (1) que le très large libellé consacré, notamment, dans la Déclaration de Vienne de 1993 doit être nuancé, le concept de hiérarchie juridique entre droits fondamentaux devant bénéficier d’une définition non pas unidimensionnelle, mais plutôt bidimensionnelle (hiérarchies formelle et matérielle); et identifient (2) les principales caractéristiques permettant d’établir l’existence de hiérarchies matérielles entre droits fondamentaux au sein d’un régime juridique donné.The Vienna Declaration, adopted June 25th, 1993 by the World Conference on Human Rights, enshrines the legal principle of indivisibility of rights and freedoms and its corollary, the absence of legal hierarchy between these rights and freedoms. This International consecration has also found a direct resonance in Canadian law, within which the Supreme Court had clearly integrated this principle in Dagenais v. Canadian Broadcasting Corp., rendered a little less than a year later. Yet for all that it can be coherent on an ideological or philosophical angle, the elimination (or prohibition) of any legal hierarchy between fundamental rights seems very unlikely to be implemented in practice. In the point of view of the authors, the very special nature of the different rights and freedoms enshrined in legal texts on human rights, inextricably linked to a certain moral view of society, underlies the establishment, over time, of a legal hierarchy between fundamental rights and freedoms in the many legal regimes that constitute the international society. Without asserting that the principle of non-hierarchy between fundamental rights must be completely set aside, the authors try to demonstrate that (1) the concept of legal hierarchy between fundamental rights is due to receive a definition not unidimensional, but rather bidimensional (formal and material forms of legal hierarchies); and (2) the main criteria to establish the existence of material hierarchies between fundamental human rights within a given legal system
