Ce texte revient sur la loi du 20 juillet 1983 relative à certaines activités d’économie sociale, qui va se révéler importante aussi bien par son objet immédiat, faciliter l’essor de la coopération dans le domaine de l’artisanat et de l’habitat social, que parce qu’elle s’inscrit dans le projet plus vaste de développement de l’économie sociale en France, dont elle constitue une première étape. Les apports de la loi, comme le soulignent les auteurs, sont multiples : offrir aux coopératives d’artisans, d’entreprises de transport et aux coopératives maritimes un cadre juridique et fiscal incitatif; redonner aux coopératives HLM une capacité d’intervention en voie d’extinction; innover en instituant l’« union d’économie sociale » (dans la filiation de laquelle s’inscrit la SCIC) et la révision coopérative. Enfin, et ce n’est pas son moindre mérite, elle accorde une consécration législative au terme et au concept sous-jacent d’« économie sociale » qui a fini par s’imposer assez largement, fût-ce avec des acceptions diverses en Europe et sur les autres continents.This article looks back at the law of 20 July 1983, which concerns certain sectors of the social economy. This law would turn out to be important both because of its immediate purpose—to facilitate the growth of tradesman and social housing cooperatives—and because it was the first stage of the larger project to develop the social economy in France. As the authors emphasize, the law made a number of contributions—by providing a legal framework and tax incentives for tradesman, transportation and maritime cooperatives, restoring social housing cooperatives' threatened ability to act, and establishing the innovations of the social economy union (which includes collective interest cooperatives) and cooperative review. Last but not least, the law gave a legislative legitimacy to the term and implicit concept of the social economy, which eventually became widely accepted in Europe and on other continents, albeit with different interpretations
