En février 2004 (n° 291), la Recma consacrait un dossier à la société coopérative européenne (SCE), dont le statut est précisé par le règlement CE du 22 juillet 2003. Il était en particulier montré comment le règlement SCE intègre dans le droit communautaire les principes fondateurs du droit coopératif, en même temps qu’il renvoie sur de nombreux points à l’application des droits nationaux spécifiques aux coopératives. Concernant le droit français, une certaine harmonie avec les principes coopératifs issus de la loi du 10 septembre 1947 était également soulignée. Cette étude permet d’aller plus loin sur la question. Les auteurs examinent quelques-uns des articles du règlement au regard de la loi de 1947 : le mode de constitution de la SCE, son administration, les droits de vote, l’émission de titres à avantages particuliers, l’affectation du résultat…In February 2004 (no. 291), Recma ran a special feature devoted to the European cooperative society (SCE), whose statute was specified by the EC regulation of 22 July 2003. It was shown in particular how the SCE regulation incorporates the founding principles of cooperative rules into Community law, while on a number of points it refers back to the application of national laws specific to cooperatives. Concerning French law, a certain harmony with the cooperative principles stemming from the law of 10 September 1947 was also underlined. This study pursues the issue further. The authors examine some of the regulation's articles with respect to the 1947 law, e.g., the formation of a SCE, its board, voting rights, issuing securities conferring special advantages, allocation of profits, winding up, etc
