Dans l’article qui suit, le dernier d’une série de trois, les auteurs poursuivent leur réflexion sur le passage d’une compréhension individuelle de la théorie des contrats à une conception reflétant davantage la complexité polyphonique et intersubjective de la relation obligationnelle. À cette fin, ils appliquent les approches dialogique et polyphonique, qui concernent l’altérité discursive et la non-unicité du sujet parlant en linguistique, à la matière contractuelle. Dans un premier temps, et afin d’élaborer des définitions fonctionnelles des deux notions en question, ils cherchent à établir la pertinence et le rôle que peuvent jouer le dialogisme et la polyphonie au sein du droit des contrats. Dans un deuxième temps, ils s’attachent à l’analyse discursive du contrat comme pratique sociale afin d’évaluer le poids des considérations intralinguistiques et extralinguistiques en matière d’analyse contractuelle. Dans un troisième temps, enfin, ils démontrent comment le modèle proposé peut s’appliquer de façon concrète. Leur objectif final est de faire un autre pas vers l’intégration des concepts de dialogisme et de polyphonie dans la notion de contrat de droit privé et vers la compréhension de la raison d’être de tels phénomènes dialogiques et polyphoniques dans l’univers juridique.In this article — which is the last in a series of three — the authors further develop their critical reflections on the transition from an individual understanding of contract theory to considerations that more explicitly illustrate the polyphonic and intersubjective complexity of the obligational relationship. To this end, borrowing from the field of linguistics, they apply the conceptual approaches of dialogism and polyphony, which relate to discursive alterity and the non-uniqueness of the speaker, to the contract matter. First of all, in order to elaborate functional definitions of these two notions, they seek to establish the relevance and the part that dialogism and polyphony may play in contract law. They then turn to the discursive analysis of the contract as a social practice in order to measure the significance of intra- and extra-linguistic considerations in relation to contractual analysis. Lastly, they demonstrate how the proposed model may be applied to authentic contract texts. The ultimate objective is to take another step towards the integration of dialogism and polyphony into the private law conception of the contract and towards the understanding of the raison d’être of such dialogical and polyphonic phenomena in the field of law
