Le but de cet article est de montrer que les relations entre brevet etliberté sont beaucoup plus complexes qu’il peut y paraître au premier abord.Fondamentalement, le brevet est conçu comme un outil d’incitation à l’innovationpermettant à son détenteur de restreindre la liberté d’autres acteurs. Nous montronstoutefois, en nous appuyons sur une revue de la littérature récente surl’utilisation stratégique des brevets et sur deux études empiriques complémentaires,que celui-ci remplit de nombreuses fonctions, dont certaines sont au contrairedirigées vers un surcroît de liberté.At first sight, the relation between patents and freedom may seem simple: Apatent is a title granting an exclusive right to use an invention. It thereforerestricts the freedom of other (potential) actors on the market. The aim of thisarticle is to show that the relation is much more complex than that. We show througha literature a review and two complementary empirical studies that patents havevarious functions among which some tend to increase the freedom of both firms andindividuals.El objetivo de este artículo es mostrar que las relaciones entre patente ylibertad son mucho más complejas de lo que podrían parecer a primera vista.Fundamentalmente, las patentes están concebidas como un instrumento de incitación ala innovación permitiendo a su propietario la restricción de la libertad de losdemás. Nosotros mostramos apoyándonos en una revisión de la literatura recientesobre la utilización estratégica de patentes et a través de dos estudios empíricos,que éstas cumplen múltiples funciones, algunas de la cuales orientadas hacia unincremento de la libertad
