L’articulation entre la loi et les accords collectifs de travail repose en droit français sur le principe constitutionnel de participation. L’évolution du système normatif est caractérisée par un développement de la part du contrat. Au système traditionnel de mise en œuvre de la loi par les accords collectifs, s’ajoutent un renforcement des exigences liées au respect des conventions par le législateur et une plus grande liberté des partenaires sociaux quant à la détermination de la substance des accords. Enfin, une réforme législative est engagée pour renforcer le rôle des partenaires sociaux dans l’élaboration des lois relatives au droit du travail.Under French law, the ongoing relationship between law and collective working agreements is grounded in the constitutional principle of participation. Changes in the normative system issue from evolution in contract law. Besides traditional implementation by the coming into force of legislation via collective agreements, the legislator has, in addition, reinforced requirements pertaining to compliance with contractual agreements and enhanced freedom for entrepreneurial associates to determine the substance of agreements. Lastly, legislative reform has been undertaken to strengthen the role of entrepreneurial associates in the making of legislation pertaining to Labour Law
