En France et au Québec, l’analyse du traitement des revendications religieuses par les juridictions nationales révèle trois modèles d’élaboration du droit des croyants par le juge étatique. Le premier modèle, celui de Jupiter, fait de la loi étatique la source transcendante et unique du droit des croyants. Pour Jupiter, c’est la loi qui hiérarchise les appartenances religieuses au sein de la société, qui identifie les croyants et qui s’applique à leur situation, à l’exclusion des droits religieux. Le deuxième modèle, celui d’Hercule, contribue à faire de la jurisprudence une source immanente et incontournable du droit des croyants. Grâce aux libertés et aux droits fondamentaux qu’il doit interpréter, Hercule joue un rôle déterminant dans l’élaboration du droit des croyants en protégeant l’autonomie privée des individus et des communautés de croyants contre la rigueur et la trop grande généralité de la loi. Le troisième et dernier modèle, celui de Minerve, n’opte pour aucune position dogmatique à l’égard de la loi, à la différence de Jupiter et d’Hercule. Pour Minerve, le droit des croyants est le fruit d’une dialectique entre l’activité normative de l’État (la loi et la jurisprudence) et l’autonomie privée des personnes (les individus et les communautés de croyants), forces créatrices qui trouvent à s’harmoniser dans ses décisions au terme du procès.In France and Québec, an analysis of the handling of religious demands by national jurisdictions points to three models indicating the evolution of legislation as applied to believers by state magistrates. The frst model, namely Jupiter, makes state law the sole transcending source of believers’ rights. For Jupiter, it is up to the law to organize the hierarchy of religious involvements within society, which identifes believers and is then applied to their circumstances, in all excluding religious rights. The second model, hereafter Hercules, contributes to the making of jurisprudence as an immanent and unavoidable source of believers’ rights. Owing to the fundamental rights and liberties that he must interpret, Hercules plays a leading role in the evolution of believers’ rights by protecting the private autonomy of individuals and the communities of believers from the strictness and the overly general defnition of the law. The third and last model, unlike Jupiter and Hercules, Minerva does not side with any dogmatic standpoint as regards legislation. For Minerva, the believers’ rights are the fruit of dialectical interaction between the normative functions of the State (the law and court rulings) and the private autonomy of the people (individuals and communities of believers), both creative forces which fnd harmony in their decisions as the process works itself out
