Dans le contexte de l’application de la méthode pragmatique et fonctionnelle, l’interrogation fondamentale qui doit guider une cour de justice, lorsqu’elle examine la décision rendue par un décideur administratif, est celle de savoir si le législateur a voulu que l’examen d’une question donnée ou la solution à y apporter relève de la compétence conférée au tribunal. En théorie, le problème est résolu puisque le tribunal supérieur doit appliquer la méthode pragmatique et fonctionnelle qui comporte quatre facteurs à examiner. Une difficulté se pose toutefois. En effet, la notion d’expertise qui, selon la Cour suprême du Canada, constitue le facteur le plus important qu’une cour doit examiner pour arrêter la norme de contrôle applicable, n’a pour l’instant fait l’objet d’aucun examen exhaustif. À ce jour, la Cour suprême n’a proposé aucune grille d’analyse qui permettrait de déterminer de façon systématique et cohérente le degré d’expertise du décideur administratif. Toutefois, ce facteur est d’une importance capitale lorsqu’un tribunal supérieur doit se demander si un décideur administratif mérite que l’on fasse preuve de retenue au moment de l’examen de la légalité d’une décision qu’il a rendue. Selon la Cour suprême, l’expertise constitue la justification fondamentale de la déférence judiciaire.In the context of an application of the pragmatic and functional approach, the fundamental interrogation that must guide a Court of Law, when it is examining the decision rendered by an administrative decision maker, is to ask whether the legislator intended the analysis of a given question or the solution it requires to be within the jurisdiction conferred upon the tribunal. In theory, the problem is resolved since the reviewing court must apply the pragmatic and functional approach comprising four factors to be examined. A difficulty arises nonetheless. Indeed, the notion of expertise, which according to the Supreme Court of Canada constitutes the most important factor that a court must examine in order to establish the applicable standard of review, has yet to be thoroughly examined. To date, the Supreme Court has not proposed a single analysis grid that would provide a systematic and coherent means of determining the administrative decision-maker’s level of expertise. However, this factor is of the utmost importance when a reviewing court must ask itself if an administrative decision-maker is entitled to some degree of deference while the legality of a decision he rendered is being examined.
