À partir d’une bibliographie des éditions commerciales du Code civil du Bas Canada parues depuis 1866, l’auteur trace un portrait de l’apparence physique du droit commun du Québec. C’est le Code civil en tant qu’objet qui retient son attention afin de lui permettre de repenser l’idée de « texte législatif » en fonction de sa matérialité comme livre. La forme matérielle du Code civil varie d’une édition à l’autre — typographie, documents connexes au Code, choix linguistiques, exactitude des textes, type de papier, etc. — et, à titre de support du travail d’interprétation, les éditions privées ont incontestablement façonné l’appréciation que l’on a du droit commun. L’article se termine par une liste bibliographique des différentes éditions du Code.Basing himself on the bibliography of the commercial editions of the Civil Code of Lower Canada published since 1866, the author seeks to present a picture of Quebec’s common law based on its physical appearance. Treating the Civil Code as an object invites a rethinking the idea of “legislative text” which takes into account its shape as a book. This material shape varies enormously from one edition of the Code to another — type-face, documents reproduced alongside the Code, linguistic choices, precision in reproduction, type of paper, etc. — and, as the site for the effort associated with interpreting the code, the commercial editions have most certainly affected the manner in which the common law is understood. This article closes with a bibliography of the different editions of the Code
