À la suite de la condamnation de la Belgique par la Cour européenne des droits de l’Homme le 13 juin 1979, le droit belge de la filiation a été « décodifié ». Le législateur a tenté de reconstruire le Code civil par la loi du 31 mars 1987 modifiant diverses dispositions légales relatives à la filiation. Cette recodification a échoué, la Cour d’arbitrage et les juridictions du fond ayant déclaré, à de multiples reprises, plusieurs dispositions nouvelles contraires aux droits de la personne, spécialement sous l’angle du principe de l’égalité et de la non-discrimination. Comment analyser cet échec ? Certes, le législateur n’a pas toujours fait preuve de suffisamment de discernement en 1987 ; certes encore, la difficulté de proposer un droit de la famille cohérent se heurte aujourd’hui à la diversité des modèles familiaux et à la disparition de repères sociaux univoques en la matière. Mais la difficulté s’explique surtout par la perte de la prévalence du législateur sur le juge, condition d’une codification stable.Following the sanctioning of Belgium by the European Court of Human Rights on June 13, 1979, Belgian law on filiation was « de-codified ». The legislator thereafter attempted to rebuild the Civil Code via the Law of March 31, 1987 amending various legal provisions pertaining to filiation. This re-codification was unsuccessful as the Court of Arbitration and courts of first instance then declared on a number of occasions many of the new provisions in contradiction with human rights, especially from the standpoint of principles of equality and non-discrimination. How may one analyze this failure ? For sure, the legislator had not consistently demonstrated enlightened judgement in 1987 ; equally sure, the difficulty proposing coherent family law collides nowadays with the diversity of typical family role-models and the disappearance of unequivocal social reference points in this field. Yet the difficulty may mainly be explained by the loss of the legislator’s predominance over judge-made law, a prerequisite for stable codification
