Comment rendre compte des fondements juridiques de la protection du corps humain ? Une doctrine ancienne héritière de Locke et certaines décisions de jurisprudence ont affirmé un droit de propriété du sujet sur son corps. Cette analyse repose sur l'affirmation au moins implicite d'une impossible distance entre le sujet et son corps, issue du platonisme, puis de la philosophie subjectiviste qui cherche à affirmer la maîtrise de la raison — d'une certaine raison — sur soi-même, sur autrui et sur le monde. Le danger est d'oublier que le corps est d'abord relation à autrui, ce qui d'ailleurs justifie sa protection contre des relations réifiantes. C'est dans cette relation même, et non dans un impossible lien de soi à soi, que doit être cherché le fondement ultime de la protection juridique du corps. Depuis la Renaissance, en philosophie, depuis la Charte des Nations Unies, en droit, le concept de respect de la dignité humaine pourrait constituer ce fondement.How should one take account of the legal grounds for protecting the human body ? An ancient doctrine handed down through Locke, plus some case-law decisions, have asserted a right of ownership over one's own body. This analysis rests, however, upon the assertion, somewhat implicit, of the impossible distance between the body and the person living in it, an inheritance from Platonism, plus the subjectivist philosophy that seeks to assert the prevalence of reason - a given reason - over oneself, other humans and the world. The danger resides in forgetting that the body is first and foremost a relationship with others, which in fact justifies its protection from relations in substantiality. It is in this earthy setting of relations, and not in an impossible soul-to-soul linkage, that the ultimate grounds founding the legal protection of the body must be sought. Since the Renaissance in philosophy and the United Nations Charter in law, the concept of respecting human dignity could constitute such grounds
