Le législateur a procédé, dans le livre neuvième du Code civil du Québec, à un renforcement du rôle de la publicité foncière en attribuant aux inscriptions de remarquables pouvoirs de preuve et d'acquisition de droits. Lorsque la réforme du système de publicité foncière sera achevée, sa mission ne se limitera plus à départager les ayants cause d'un auteur commun ni à déterminer le rang des titulaires de sûretés réelles. La publicité servira, en outre, à prouver l'existence d'un droit, allant même jusqu'à permettre d'acquérir des droits indépendamment de la nullité du titre en vertu duquel ils auraient été transmis. Ces nouveaux rôles ne seront pas sans rappeler ceux qui, sous le régime de l'ancien Code, étaient dévolus à la prescription acquisitive. Il y a toutefois loin de la coupe aux lèvres. Les chances que la réforme des règles sur la publicité foncière soit appliquée demeurent relativement minces, comme en font foi, notamment, des difficultés liées à la mise en oeuvre des dispositions du nouveau Code ainsi qu'un projet prioritaire de numérisation et de diffusion, sur l'inforoute, des documents archivés dans les bureaux de la publicité des droits.In Book Nine of the Civil Code of Québec, the legislator went about reinforcing the role played by publication by registration in the land register by granting to registrations important powers of evidence and acquisition of rights.
