Au cours des 30 dernières années, le commerce international s'est libéralisé à un rythme sans précédent. Après s'être concentré en premier lieu sur les obstacles tarifaires, le GATT s'est ensuite attaqué aux obstacles non tarifaires, principalement à partir du Tokyo Round. Plusieurs progrès ont été réalisés et on peut dire aujourd'hui, après les récents accords du GATT, que le commerce international s'est affranchi de la plupart de ces obstacles, bien que beaucoup reste à faire. Cela étant, les États demeurent toujours animés par un certain protectionnisme et n'hésitent pas à recourir à d'autres moyens qui, pour l'essentiel, ne relèvent pas toujours du GATT. C'est le cas de la politique fiscale. Or, à plusieurs reprises dans le passé, les États ont tenté de déjouer ou de contourner les règles du GATT en recourant à des mesures fiscales afin de protéger leurs industries ou encore d'encourager de façon déloyale leurs exportations. L'objectif du présent article est de revoir brièvement les mesures fiscales utilisées par les États qui ont ou peuvent avoir une incidence sur le commerce international et d'analyser leur légalité au regard du GATT ou d'accords, tels que l'ALE et l'ALENA. La conclusion principale qui se dégage est que les organisations internationales doivent surveiller de plus près le recours à ces mesures, lesquelles peuvent avoir un effet négatif sur le commerce international.Over the last 30 years, international trade has been liberalized at an outstanding pace. After tariffs, the GATT had to tackle a much more difficult problem arising from the application of non tariff barriers. This has been done under the Tokyo Round multilateral trade negotiations and substantial progress has taken place since that time. Today, it is fair to say that an important portion of non tariff barriers has been or is to be eliminated, although a lot of work has yet to be done. Given that, States are still driven by «protectionism» and do not hesitate to apply other means which do not necessarily fall under the GATT legal framework. Among other things, this is particularly the case with tax measures which have been used by contracting parties in contradiction with or to circumvent the GA TT in order to protect their industries or to unfairily boost their exports. The purpose of this article is to review those tax measures which have been used and which have an effect on international trade and to analyze their legality with respect to the GATT or to other international agreements, such as the Canada-United States Free Trade Agreement or the North American Free Trade Agreement. The main conclusion is that international organizations should better and closely monitor tax measures having negative effects on international trade
