Les nouvelles techniques de reproduction posent avec acuité de nombreux et tout nouveaux problèmes éthiques, et un large questionnement s'est engagé aussi bien au Canada que dans plusieurs autres pays relativement au caractère acceptable ou non des possibilités ouvertes par les sciences. Toutefois, ces débats eux-mêmes soulèvent une question fondamentale : celle des rapports entre les sciences et le droit. S'agit-il de domaines complètement distincts, sans relation aucune l'un avec l'autre ? La science se trouve-t-elle, en raison de son objet, en dehors du domaine du droit, ce qui rendrait impossible pour celui-ci de légiférer relativement à la science ? Le droit est-il à l'abri de l'influence des sciences ? C'est à ces questions essentielles que l'auteure tente de répondre ici. La détermination du domaine du droit, et la confrontation de ce domaine avec les divers aspects des sciences, permet de déterminer relativement à l'égard desquels le droit peut légiférer. Les faits révèlent toutefois que les sciences tendent à influencer le droit, généralement à son insu, en manipulant des concepts relatifs aux valeurs fondamentales du droit contemporain. La modification de la place respective de la philosophie et des sciences dans le monde des valeurs explique la forte influence acquise par les sciences et la difficulté qu'éprouve le droit à résister à l'influence occulte de celles-ci.New reproduction techniques have acutely underscored many unprecedented ethical problems and numerous questions have been raised both in Canada and abroad relating to the acceptable or non-acceptable nature of new possibilities offered by science. Yet, these debates raise another even more fundamental issue, that of the balance of power between science and systems of law. Are these totally distinct domains without any relationship between them ? Owing to its object of study, is science outside the purview of systems of law and if so, would it be impossible for the latter to pass legislation pertaining to science ? Are legal systems sheltered from the influence of science ? This article attempts to address these essential questions. The demarcation of the field of law and the confronting of this demarcation with various aspects of science make it possible to determine in which areas laws may be applied. Evidence demonstrates, nonetheless, that sciences tend to influence legal systems by manipulating concepts relating to the fundamental values of our legal system, without this process being noticed. The alteration of the respective place of philosophy and sciences in the universe of values explains the strong influence acquired by sciences and the difficulty that legal systems have in resisting its silent influence
