La Loi sur la protection de la jeunesse de 1977 a été adoptée au terme d'une décennie de débats sociaux et parlementaires ponctuée par la présentation à l'Assemblée nationale de quatre propositions législatives successives. Appelée à remplacer une loi remontant aux années 1950, la loi de 1977 représente d'importants enjeux politiques, philosophiques et professionnels. Autour des thèmes fondamentaux que sont la « déjudiciarisation », les droits et l'intérêt de l'enfant, le champ d'application de la loi ainsi que les instances de réception, d'orientation et de contrôle destinées à en assurer l'application, le présent exposé retrace les discussions intervenues en commission parlementaire et ailleurs et tente de reconstituer le processus de maturation de ce texte législatif, le tout afin de mieux établir les lignes de force de cette réforme et les choix politiques qu'elle reflète.The 1977 Youth Protection Act was passed following a decade of social and parliamentary debate marked by the presentation of four successive bills in the National Assembly. Intended to replace an act dating from the 1950's, the 1977 Act introduced substantial critical political, philosophical and professional factors. Revolving around themes such as reducing the role of courts of law, the rights and interests of the child, the scope of application plus the proper administrative procedures for receiving, orienting and monitoring to ensure enforcement of the Act, this account recalls the discussions held in parliamentary commission and elsewhere and attempts to capture the maturing process by which the draft ultimately became law—all in a context emphasizing the main thrusts of this reform and the political choices reflected therein
