Cette réalité géographique et juridique que constitue le territoire du Québec est l'oeuvre d'une histoire coloniale et militaire qui s'échelonne sur quelque 250 ans. Au gré des circonstances, cet espace québécois a diminué et augmenté à plusieurs reprises. Mais pour sa quasi-totalité, il semble bien qu'il était ce qu'il est aujourd'hui quand le Québec est devenu membre de la fédération canadienne en 1867. Contrairement à ce qu'on croit le plus souvent, l'Acte de Québec de 1774 l'avait vraisemblablement défini comme ayant déjà l'essentiel de cette étendue contemporaine. Dans toute son intégralité, ce territoire est bien un territoire au sens du droit constitutionnel. Il est l'espace par rapport auquel la collectivité québécoise a le pouvoir défaire des lois par l'entremise de son Parlement. Or ce pourvoir est par définition, en droit constitutionnel, un pouvoir originaire que seul un amendement constitutionnel formel peut entamer.The territory of the province of Quebec is the result of a succession of colonial and military events that started about 250 years ago with the British conquest of Nouvelle-France. Of this evolution the most notable legal landmark is still the Quebec Act, 1774, under which Quebec then recovered its pre-conquest territory. Notwithstanding the territorial Acts of 1898 and 1912, it remains the true legal basis for almost all contemporary Quebec territory. This territory is without any exception the area upon which the people of Quebec can legislate through its elected Parliament. In Constitutional Law, legislative power is a power which is sovereign in nature, in the sense that it is delegated by no one and cannot be delegated to any one. In any given situation, it can be modified only by means of a formal amendement to the Constitution
