La Loi sur l'assurance automobile constitue l'exemple par excellence d'une loi remédiatrice. Elle fut adoptée en 1977 pour répondre à une insatisfaction généralisée à l'égard du système de droit commun de la responsabilité civile. La règle de l'interprétation large et libérale, explicitement édictée à l'article 41 de la Loi d'interprétation, devrait donc être appliquée sans discussion. Cependant, l'auteur expose dans les pages qui suivent que la situation est loin d'être aussi claire. Les exemples d'interprétation manifestement restrictive côtoient des décisions plus conformes au voeu du législateur. Celui-ci a d'ailleurs restreint le champ d'application de la loi, dans une réforme entrée en vigueur le 1er janvier 1990. Si la situation est préoccupante, elle n'est cependant pas désespérée. L'auteur souligne l'existence d'arrêts plus récents de la Cour d'appel où la règle de l'interprétation large et libérale semble mieux respectée. Cette tendance devra, selon lui, s'accompagner d'une révision en profondeur du critère de la causalité, tel qu'il est présentement appliqué par les tribunaux.The Automobile Insurance Act constitutes a prime example of remedial legislation. It was enacted in 1977 to respond to overall dissatisfaction regarding the general law governing civil liability. The broad and liberal interpretation rule, explicitly laid down in Section 41 of the Interpretation Act, had to be applied without any discussion. In the following pages, the author explains how the situation is anything but clear. Manifestly restrictive examples of interpretation run side-by-side with decisions more in conformity with the desire of the legislator. This same legislator further restrained the scope of application of the statute by a reform enacted on January 1, 1990. Although the situation may be alarming, it is not impossible. The author emphasizes the existence of more recent decisions from the Court of Appeal in which the broad and liberal interpretation rule seems to be better respected. From the author's viewpoint this trend should be accompanied by an in-depth revision of the causality criterion, as presently applied by the courts, in their interpretation of the Automobile Insurance Act
