L'auteur s'interroge sur l'importance des normes non formalisées dans les systèmes normatifs institutionnalisés. Il conteste l'approche réductrice du positivisme institutionnel, qui distingue le droit du non juridique par le critère de la source et qui privilégie en fait un modèle particulier de norme: la proposition formalisée émanant d'un organe législatif. L'auteur propose plutôt une typologie combinant le mode d'élaboration des normes et la manière dont on en extrait la signification. Dans cette optique plus sociologique, la question de la source du droit devient un problème d'argument et la fonction d'une norme n'apparaît plus fondamentalement affectée par sa formulation explicite dans une loi. S'il est vrai que la naissance d'institutions spécifiquement chargées d'appliquer la loi oriente la recherche normative vers les normes explicites formulées par ces institutions, il reste que, d'un point de vue dynamique, seules les nonnes implicites et "inférentielles" sont réellement normatives.The author questions thé importance of non-formalized norms in institutionalized normative systems. He contests the reductive approach of institutional positivism, which distinguishes between the law and the non-legal by the criterion of source, and which in fact favors a particular model of norm: the formalized proposal originating from the legislative branch. In its place the author proposes a typology combining the mode of development of norms and the way which meaning is extracted from them. From this more sociológica! point of view, the question of the source of law becomes a problem of argumentation, and the function of a norm no longer appears fundamentally affected by its explicit formulation in any particular law. While it is true that the birth of institutions specifically set up to enforce the law directs normative research towards explicit norms formulated by these institutions, it remains that, from a dynamic point of view, only implicit and 'inferential' norms are really normative.El autor se interroga sobre la importancia de las normas no formalizadas dentro de los sistemas normativos institucionalizados. Contesta el enfoque reduccionista del positivismo institucional que distingue el derecho de lo no jurídico por el criterio de su origen y que privilegia en el hecho un modelo particular de norma: la proposición formalizada emanada de un órgano legislativo. El autor propone más bien una tipología combinando el modo de elaboración de las normas y la manera como se extrae su significado. En esta óptica más sociológica la cuestión del origejj del derecho se convierte en un problema de peso y la función de una norma no aparece más fundamentalmente afectada por su formulación explícita dentro de una ley. Si bien es cierto que el nacimiento de las instituciones encargadas específicamente de aplicar la ley orienta la investigación normativa hacia las normas explícitas formuladas por estas instituciones, por otra parte, desde un punto de vista dinámico, solo las normas implícitas e "infercnciales" son realmente normativas
