In this paper the author analyzes the agreement of the parties, which constitutes a basis and a precondition for introducing the special simplified procedural forms. The paper pays special attention to the consent of the accused. The author points out the trend of consensus that establishes a new way of conduct, which is different from the classical understanding of the criminal procedure as a conflict of the opposing parties.
