This paper deals with the legal aspects of the protection of the privacy of personal data and of the protection of mental creations. At first the essential parts of the Austrian data protection law and of the Austrian copyright are presented, followed by a comparison with the corresponding German laws. Then current problems of these two fields are discussed. Many problems are a result of the present change from a service society to an information society, where information is the most important good.
